Abstract

Kata mawaris juga identik dengan kata faraid yang berasal dari kata faridah yang berarti bagian yang sudah ditentukan (al-mafrudah). Ilmu pembagian warisan kemudian dikenal dengan ilmu faraid. Seperti hukum Islam pada umumnya, keberadaan hukum waris Islam dalam masyarakat, baik pada secara umum maupun pada khusus tentu bukan tanpa tujuan. Secara umum, tujuan hukum waris Islam adalah agar hamba memperoleh
keuntungan dalam mengelola hartanya.
